RCPO v Johnson and another – Tainted Gift

Summary:

The defendant was convicted of cheating the public revenue (in relation to a VAT MTIC 'carousel' fraud) and money laundering. He was sentenced to ten and half years' imprisonment and a confiscation order was made for more than £26million.

R v McIntosh; R v Marsden – Hidden Assets

22 June 2011

Summary:

Following convictions for cheating the public revenue in relation to a VAT MTIC fraud, confiscation orders were made against two defendants for more than £3.6million. The defendants appealed.

The High Court was asked to consider whether the amounts shown on the orders were excessive and that the amount of the defendants realisable assets was less than the amount by which they benefitted from the fraud.

R v Takkar – Benefit obtained

Following convictions for conspiracy to cheat the public revenue (in relation to a VAT MTIC fraud) and fraudulent trading, a confiscation order was imposed for more than £5.3million. The defendant appealed.
