All businesses reward their employees with pay and/or benefits-in-kind, which inevitably means that they have to deal complex employment tax issues. Employers are responsible for correctly operating the PAYE/NIC system and reporting benefits-in-kind and the costs of getting things wrong can be extremely high.
From time to time, businesses will also have to deal with unfamiliar issues such as termination payments or what to do about employees either coming from or going to work abroad. Special tax rules and systems apply to certain industries like construction and hospitality and leisure and these must be fully understood to ensure proper compliance.
Many employers also use consultants as part of their business and deciding the correct employment status of a worker has important tax and employment law consequences. Getting these issues wrong can lead to significant tax demands, Employment Tribunal claims or both. Consultants themselves need to be aware of special IR35 rules, which could apply to them. These rules are constantly changing and evolving and keeping abreast of the legislation and case law is difficult.
Almost all employees are entitled to be paid at least the National Minimum Wage. Whilst this in itself sounds straightforward, many businesses are unaware of the detailed records that are often required to demonstrate that this has been done. Again, the costs of getting things wrong can be punitive.
Finally, employers also have to deal with the fact that HM Revenue & Customs (HMRC) carries out more Employer Compliance Reviews than any other type of business tax enquiry. We look for opportunities to use all relevant exemptions and reliefs to minimise both your own and your employees' tax liabilities.
Finally, we understand that businesses sometimes face cash-flow difficulties such that there are problems in paying any PAYE/NIC due. If a prior agreement has not been reached with HMRC, late payment this can result extra charges being imposed by HMRC. Furthermore, the possibility of distraint (i.e. the removal and sale of business assets), County Court and even Winding Up proceedings then looms large.
